1. Acceptance of Terms
By accessing or using AI Spritesheet Maker (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of the terms, then you may not access the Service.
2. Description of Service
AI Spritesheet Maker is a web-based application that allows users to generate spritesheets using artificial intelligence. The Service may offer various features, including but not limited to AI-powered image generation, an interactive canvas for arranging sprites, animation previews, and export functionalities.
3. User Accounts
To access certain features of the Service, you may be required to create an account. You are responsible for safeguarding your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Subscriptions and Payments
The Service may offer subscription plans (e.g., Starter, Indie, Pro, Studio) that provide access to specific features and generation allowances. We also offer one-time purchases of generation credits ("Credit Packs"). All payments are processed through a third-party payment processor (e.g., Stripe).
Subscription Billing: Subscriptions are billed on a recurring basis (e.g., monthly). You will be billed in advance of the applicable subscription period. Subscriptions will automatically renew unless canceled by you or by us.
Credit Packs: Credit Packs are a one-time purchase and credits can be used as described at the time of purchase. Credits may have an expiration date or other conditions.
Free Tier/Trial Credits: We may offer free trial credits or a free tier with limited usage. These are subject to change or discontinuation at our discretion.
Refunds: All purchases are generally non-refundable except as required by law or as explicitly stated in our refund policy.
5. Content Ownership and Usage
Your Content: You retain ownership of any original content you provide to the Service (e.g., text prompts).
AI-Generated Content: The ownership of spritesheets and images generated by the AI through the Service ("AI-Generated Content") is subject to the terms of the underlying AI models used and our specific licensing. Generally, subject to your compliance with these Terms and payment of any applicable fees, we grant you a license to use the AI-Generated Content for your projects, including commercial projects, unless otherwise specified. You are responsible for ensuring that your use of AI-Generated Content complies with all applicable laws and does not infringe on third-party rights.
The nature of machine learning means that output may not be unique across users and the Service may generate the same or similar output for AI Spritesheet Maker or a third party. Other users may also use similar prompts and receive similar content.
6. Prohibited Uses
You agree not to use the Service for any unlawful purpose or in any way that could harm the Service or its users. Prohibited uses include, but are not limited to:
- Generating illegal content or content that infringes on intellectual property rights.
- Attempting to reverse-engineer or discover the underlying AI models.
- Using automated systems to access the Service in a way that consumes excessive resources.
- Sharing your account credentials or allowing others to use your account in a way that violates your subscription terms.
- Using the Service to create content that is defamatory, obscene, offensive, or promotes discrimination or violence.
7. Disclaimers
The Service is provided "as is" and "as available" without any warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure. AI-generated content can sometimes be unpredictable or contain inaccuracies; you should review all generated content carefully before use.
8. Limitation of Liability
To the fullest extent permitted by law, AI Spritesheet Maker and its affiliates, officers, employees, agents, suppliers, or licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
9. Governing Law
These Terms shall be governed and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.
10. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
